Praise be to God, who revealed the Book, controls the clouds, defeats factionalism, and says in His Book "But when the forbidden months are past, then fight and slay the pagans wherever ye find them, seize them, beleaguer them, and lie in wait for them in every stratagem (of war)"; ** Qur’an 9:05

and peace be upon our Prophet, Muhammad Bin-'Abdallah, who said "I have been sent with the sword between my hands to ensure that no one but God is worshipped, God who put my livelihood under the shadow of my spear and who inflicts humiliation and scorn on those who disobey my orders." ** Qur’an ?

The Arabian Peninsula has never--since God made it flat, created its desert, and encircled it with seas--been stormed by any forces like the crusader armies now spreading in it like locusts, consuming its riches and destroying its plantations. All this is happening at a time when nations are attacking Muslims like people fighting over a plate of food. In the light of the grave situation and the lack of support, we and you are obliged to discuss current events, and we should all agree on how to settle the matter. No one argues today about three facts that are known to everyone; we will list them, in order to remind everyone:

First, for over seven years the United States has been occupying the lands of Islam in the holiest of places, the Arabian Peninsula, plundering its riches, dictating to its rulers, humiliating its people, terrorizing its neighbors, and turning its bases in the Peninsula into a spearhead through which to fight the neighboring Muslim peoples. If some people have formerly debated the fact of the occupation, all the people of the Peninsula have now acknowledged it. The best proof of this is the Americans' continuing aggression against the Iraqi people using the Peninsula as a staging post, even though all its rulers are against their territories being used to that end, still they are helpless.

Second, despite the great devastation inflicted on the Iraqi people by the crusader-Zionist alliance, and despite the huge number of those killed, in excess of 1 million... despite all this, the Americans are once against trying to repeat the horrific massacres, as though they are not content with the protracted blockade imposed after the ferocious war or the fragmentation and devastation. So now they come to annihilate what is left of this people and to humiliate their Muslim neighbors.

Third, if the Americans' aims behind these wars are religious and economic, the aim is also to serve the Jews' petty state and divert attention from its occupation of Jerusalem and murder of Muslims there. The best proof of this is their eagerness to destroy Iraq, the strongest neighboring Arab state, and their endeavor to fragment all the states of the region such as Iraq, Saudi Arabia, Egypt, and Sudan into paper statelets and through their disunion and weakness to guarantee Israel's survival and the continuation of the brutal crusade occupation of the Peninsula.

All these crimes and sins committed by the Americans are a clear declaration of war on God, his messenger, and Muslims. And ulema have throughout Islamic history unanimously agreed that the jihad is an individual duty if the enemy destroys the Muslim countries. This was revealed by Imam Bin-Qadamah in "Al- Mughni," Imam al-Kisa'i in "Al- Bada'i," al-Qurtubi in his interpretation, and the shaykh of al-Islam in his books, where he said "As for the militant struggle, it is aimed at defending sanctity and religion, and it is a duty as agreed. Nothing is more sacred than belief except repulsing an enemy who is attacking religion and life." **Qur’an 9:044

On that basis, and in compliance with God's order, we issue the following fatwa to all Muslims. The ruling to kill the Americans and their allies--civilians and military--is an individual duty for every Muslim who can do it in any country in which it is possible to do it, in order to liberate the al-Aqsa Mosque and the holy mosque from their grip, and in order for their armies to move out of all the lands of Islam, defeated and unable to threaten any Muslim. This is in accordance with the words of Almighty God, "and fight the pagans all together as they fight you all together," ** Qur'a 9:036


and "fight them until there is no more tumult or oppression, and there prevail justice and faith in God." ** Qur'an 2:193


This is in addition to the words of Almighty God "And why should ye not fight in the cause of God and of those who, being weak, are ill-treated and oppressed--women and children, whose cry is 'Our Lord, rescue us from this town, whose people are oppressors; and raise for us from thee one who will help!'" **Qur’an 4:075

We -- with God's help -- call on every Muslim who believes in God and wishes to be rewarded to comply with God's order to kill the Americans and plunder their money wherever and whenever they find it. We also call on Muslim ulema, leaders, youths, and soldiers to launch the raid on Satan's U.S. troops and the devil's supporters allying with them, and to displace those who are behind them so that they may learn a lesson.
Almighty God said "O ye who believe, give your response to God and His Apostle, when He calleth you to that which will give you life. And know that God cometh between a man and his heart, and that it is He to whom ye shall all be gathered." **Qur’an 8:024

Almighty God also says "O ye who believe, what is the matter with you, that when ye are asked to go forth in the cause of God, ye cling so heavily to the earth! Do ye prefer the life of this world to the hereafter? But little is the comfort of this life, as compared with the hereafter. Unless ye go forth, He will punish you with a grievous penalty, and put others in your place; but Him ye would not harm in the least. For God hath power over all things." **Qur’an 9:038

Almighty God also says "So lose no heart, nor fall into despair. For ye must gain mastery if ye are true in faith." **Qur’an 3:139

Islamic courts get foothold in Canada

Toronto, ON, Apr. 28 (UPI) -- Muslims in the Canadian province of Ontario can soon turn to settling disputes in their own courts, known as sharia, the Washington post reported.

Muslim promoters of sharia arbitration said no cases have yet been decided but the process is set. Islamic leaders created an Islamic Court of Civil Justice last fall and it has chosen arbitrators who have undergone training in sharia and Canadian civil law.

"People can agree to resolve disputes any way acceptable," said Brendan Crawley, a spokesman for the Ontario Attorney General's office said in an interview. He said the arbitration act has a number of safeguards, including the requirement that parties enter into arbitration only on a voluntary basis, and any decisions by arbitrators are subject to court ratification.

Jewish courts, using similar methods, have long been operating in Ontario. Such a court, called a Beit Din, deals with monetary, business and family disputes, but no criminal matters.

"Jewish courts have been operating in Toronto for as long as Jews have been here, hundreds of years," said Rabbi Reuven Tradburks, secretary of the Beit Din of Toronto. He said he had not heard of cases decided by arbitrators in Jewish courts that had been overturned.

Corporal and capital punishment: hands and feet amputations for robbery, and lashings for lesser crimes such as "sexual deviance" and drunkenness; in capital punishment, including public executions by beheading. Women's rights: By western standards Saudi women face severe discrimination in many aspects of their lives, including the family, education, employment, and the justice system. Religious police enforce a modesty code of dress, sometimes even asking American Armed Services women to cover their heads. ***Violation to art. 1, 2, 3, 10, 13, 17 of the Human Rights declaration

Slavery: Saudi Arabia was among the last nations to end the practice of slavery; the practice was ended by neighboring Qatar in 1952, the Yemen Arab Republic in 1962, the UAE in 1963, South Yemen in 1967, and Oman in 1970. Some of these states, such as Yemen, were British protectorates. The British left South Yemen without forcing it to give up slavery, but did pressure the UAE into giving it up. Saudi Arabia officially outlawed slavery in 1962, freeing that year 10,000 slaves out of an estimated 15,000-30,000. ***Article No. 4

Political Freedoms: Freedom of speech is restricted in Saudi Arabia with criticisms of the government stifled. Trade unions and political organizations are banned. ***Violation to art. 23

Religious freedoms: Saudi Arabia forbids missionary work by any religion other than Islam. Officially all religions other than Islam are banned and churches are not allowed outside of foreign enclaves. Other religions, specifically Christianity, Judaism, and Zoroastrianism, are not tolerated. In an extreme case foreign workers have been incarcerated in the past for owning a rosary. "Freedom of religion does not exist," the U.S. State Department's 1997 Human Rights Report on Saudi Arabia states. "Islam is the official religion, and all citizens must be Muslims. The government prohibits the public practice of other religions." "It is absurd to impose on an individual or a society rights that are alien to its beliefs or principles," Crown Prince Abdullah bin Abdul Aziz at the U.N. Third Millennium summit in New York City, New York on 6 September. ***Violation to article 19 and 20

Hamed al-Ali - Kuwaiti scholar (in his 40s). Serves as lecturer and preacher. Graduated al-Madina University in Saudi Arabia. Published Islamic verdicts justifying suicide attacks committed by Palestinians against Israelis.

Saif al-Din al-Ansari (nom de guerre) - Senior al-Qaeda leader and ideologist. Expresses support for total extermination of infidels through jihad for the sake of Allah.

Salman bin Fahed al-'Auda - Prominent Saudi scholar. Born in Baser (Buraida, Saudi Arabia) in 1956. Serves as Islamic researcher, lecturer and preacher. Runs the Islamic website www.islamtoday.net. Arrested by Saudi security services in 1994 for his radical views and jailed until 1999. Al-'Auda considers jihad against the U.S. in Muslim countries as justified self-defense in reaction to American occupation. He attributes great importance to the daawa (spreading Islam by education and preaching).

Nasser bin Hamed al-Fahd - Saudi scholar. Born in 1968 in Riyadh (Saudi Arabia). Graduated Al-Imam University in Riyadh. Served as lecturer in Islamic affairs. Jailed by Saudis 1994-1997. Al-Fahd published articles and religious edicts supporting the Taliban regime in Afghanistan and denouncing Muslims who cooperated with the U.S. In May 2003 he justified use of weapons of mass destruction against the U.S. as a retaliatory measure. Along with Ali al-Khudeir and Ahmed al-Khaldi, he incited to commit attacks against Westerners and openly supported the Riyadh bombings. In May 2003 he was rearrested by the Saudi security services and charged with advocating violence in sermons in mosques and on the Internet. Under pressure by Saudi authorities, which began cracking down on militants believed responsible for a string of attacks in Saudi Arabia, al-Fahd renounced militancy and attacks against innocent people inside Saudi Arabia in an interview on Saudi TV (November 2003). He focused on the past tendency of clerics to widely use the doctrine of takfir, charging that Muslims have become infidels and should be treated accordingly.

Suliman Abu Ghaith - Born in the 1970s in Kuwait. Former religious studies teacher. Serves as al-Qaeda's spokesperson. He left Kuwait in 2000. Abu Ghaith was stripped of his citizenship after he called for retaliation against the U.S. during the war in Afghanistan. He is considered as one of Osama bin Laden's closest associates.
Abu Ayman al-Hilali (nom de guerre) - Senior al-Qaeda leader and ideologist. Supports uncompromising jihad against infidels and religiously justifies mass killings of Western civilians.

Abd al-Aziz al-Jarbou' - Saudi scholar. Published religious edicts justifying jihad against the U.S. and al-Qaeda's attack on the U.S. in September 2001. Considered a supporter of al-Qaeda's terrorist global network. Arrested in 2003 by Saudi security services.

Ali al-Khudeir - Saudi scholar. Born in 1954 in Riyadh (Saudi Arabia). Graduated Al-Imam University in Qusaim. Hamud bin Uqla al-Shuaibi, one of his teachers (see below), had great influence on shaping his Islamic views. Al-Khudeir published articles and religious edicts supporting the Taliban regime in Afganistan including the destruction of the Hindu statues, as a part of jihad against the infidels. He religiously justified al-Qaeda's attack on the U.S. in September 2001. Along with Nasser al-Fahd and Ahmed al-Khaldi, he incited to commit attacks against Westerners and openly supported the Riyadh bombings. He was arrested by the Saudi security services and charged with advocating violence in sermons in mosques and on the Internet. Under pressure from Saudi authorities, which began cracking down on militants believed responsible for a string of attacks in Saudi Arabia, in an interview on Saudi TV (November 2003), al-Khudeir reversed his religious edicts justifying attacks against innocent people including Westerners under regime protection inside Saudi Arabia and encouraging Saudi youth to join the jihad in Iraq and Afghanistan. Like Nasser al-Fahd, he focused on limiting the application of takfir, which had largely internal implications.

Abu Muhammad al-Maqdisi - Palestinian scholar (born in Nablus), living in Jordan. Al-Maqdisi was involved in directing Islamist terrorist groups in Jordan under various names - Bay'at al-Imam, Jaysh Muhammad, Al-Islah wal-Tahaddi - along with the Islamic Movement for Change, which carried out the terrorist attack in Riyadh in November 1995 in which five American officials were killed. He was imprisoned between 1995 and 1999 and detained again in the recent wave of arrests of Islamists in Jordan.

Muhammad Saleh al-Munajjid - Saudi scholar. Born in 1961. Graduated Saudi University in Dhahran. The late grand mufti, Abd al-Aziz al-Baz, was one of his teachers, who had great influence in shaping his views. Serves as Islamic researcher and preacher.

Yusuf al-Qaradawi - Prominent Islamic scholar and well-known preacher. Born in Egypt (1926), lives in Qatar. Known as a member of the Muslim Brotherhood. Qaradawi heads the Sunni studies department at Qatar University. He was the first Sunni Muslim scholar to give religious legitimacy to the suicide operations of Hamas (1995), and to the participation of women in suicide attacks. Qaradawi has generally defended bin Laden as a representative and defender of oppressed Muslims against the "American and Zionist evilness," even though he condemned the attacks on American soil against innocent civilians.

Hamud bin Uqla al-Shuaibi - Prominent and influential Saudi scholar. Born in 1927 in al-Shiqqa (Buraida, Saudi Arabia), died in 2001. Lost his eyesight in the age of 9 as a result of disease. Learned Islamic studies and law. Served as teacher of Islamic affairs. His students included a number of important Saudi religious leaders, including the current grand mufti. Al-Shuaibi published religious edicts supporting the Taliban regime in Afghanistan including the destruction of the Hindu statues, as part of jihad against the infidels. He religiously justified al-Qaeda's attack on the U.S. in September 2001 and gave religious legitimacy to the suicide attacks against Israel carried out by Palestinians. In October 2001, bin Laden cited al-Shuaibi when he spoke of his justification for killing Jews and Christians.

Abd al-Rahman al-Sudays - Imam of the central mosque in Mecca. Well-known for his radical Islamic views and ardent preaching against the infidels.

Suliman bin Nasser al-Ulwan - Saudi scholar. Born in 1969 in Buraida. Serves as lecturer and preacher. Published religious edict justifying the Palestinian suicide attacks against Israeli civilians. In 2001 he stated that the attacks on the World Trade Center were an act of jihad.

Ahmad Yassin - Palestinian religious leader; born in 1937 in Ashkelon (today in southern Israel); worked as teacher, preacher, and community worker; completely paralyzed following an accident in his youth; founder of the Islamic Center in Gaza in 1973, which soon controlled all religious institutions; founder and spiritual leader of Hamas, the Islamic Resistance Movement, and its military wing, Izz al-Dinn al-Qassam, which is responsible for the deaths of hundreds of Israelis in terrorist attacks, including suicide bombings, since the 1990s. An Israeli court convicted Yassin in 1989 of ordering Hamas members to kidnap and kill two Israeli soldiers. He was released from jail in 1997 to appease Jordan after Israel's failed attempt to assassinate Hamas leader Khaled Mashal in Amman. Yassin opposed the previously signed agreements between Israel and the Palestinian Authority, and maintains that eliminating Israel and the establishment of an Islamic state in Palestine is a religious duty.

The end of Europe as we know it

We live during fascinating times. Today, with a computer on hand and a good search engine, anyone can observe the political and historical trends, and make some predictions. I would predict that if Iran obtains nuclear capabilities it will demand Dimmitude from Europe and Europe will comply. I believe that it is possible that within the 5 years the European government will join Islam in an alliance against US and implicitly subscribe to the ‘Pact of Umar’. This will be the end of the world… Umar? What is it? Read below and judge for yourself. Is this how a decadent an post-modern European wants to exist?

The Status of Non-Muslims Under Muslim Rule

After the rapid expansion of the Muslim dominion in the 7th century,
Muslims leaders were required to work out a way of dealing with Non-Muslims, who remained in the majority in many areas for centuries. The solution was to develop the notion of the "dhimma", or "protected person". The Dhimmis were required to pay an extra tax, but usually they were unmolested. This compares well with the treatment meted out to non-Christians in Christian Europe. The Pact of Umar is supposed to have been the peace accord offered by the Caliph Umar to the Christians of Syria, a "pact" which formed the pattern of later interaction.

We heard from 'Abd al-Rahman ibn Ghanam [died 78/697] as follows: When
Umar ibn al-Khattab, may God be pleased with him, accorded a peace to the Christians of Syria, we wrote to him as follows:

In the name of God, the Merciful and Compassionate. This is a letter to the servant of God Umar [ibn al-Khattab], Commander of the Faithful, from the Christians of such-and-such a city. When you came against us, we asked you for safe-conduct (aman) for ourselves, our descendants, our property, and the people of our community, and we undertook the following obligations toward you:

We shall not build, in our cities or in their neighborhood, new monasteries, Churches, convents, or monks' cells, nor shall we repair, by day or by night, such of them as fall in ruins or are situated in the quarters of the Muslims.

We shall keep our gates wide open for passersby and travelers. We shall give board and lodging to all Muslims who pass our way for three days.

We shall not give shelter in our churches or in our dwellings to any spy, nor bide him from the Muslims.

We shall not teach the Qur'an to our children.

We shall not manifest our religion publicly nor convert anyone to it. We shall not prevent any of our kin from entering Islam if they wish it.

We shall show respect toward the Muslims, and we shall rise from our seats when they wish to sit.

We shall not seek to resemble the Muslims by imitating any of their garments, the qalansuwa, the turban, footwear, or the parting of the hair. We shall not speak as they do, nor shall we adopt their kunyas.

We shall not mount on saddles, nor shall we gird swords nor bear any kind of arms nor carry them on our persons.

We shall not engrave Arabic inscriptions on our seals.

We shall not sell fermented drinks.

We shall clip the fronts of our heads.

We shall always dress in the same way wherever we may be, and we shall bind the zunar round our waists

We shall not display our crosses or our books in the roads or markets of the Muslims. We shall use only clappers in our churches very softly. We shall not raise our voices when following our dead. We shall not show lights on any of the roads of the Muslims or in their markets. We shall not bury our dead near the
Muslims.

We shall not take slaves who have been allotted to Muslims.

We shall not build houses overtopping the houses of the Muslims.

(When I brought the letter to Umar, may God be pleased with him, he added, "We shall not strike a Muslim.")

We accept these conditions for ourselves and for the people of our community, and in return we receive safe conduct.

If we in any way violate these undertakings for which we ourselves stand surety, we forfeit our covenant [dhimma], and we become liable to the penalties for contumacy and sedition.

Umar ibn al-Khittab replied: Sign what they ask, but add two clauses and impose them in addition to those which they have undertaken. They are: "They shall not buy anyone made prisoner by the Muslims," and "Whoever strikes a Muslim with deliberate intent shall forfeit the protection of this pact."

Article 3. Everyone has the right to life, liberty and security of person.

3:151 we will cast terror into the hearts of those who disbelieve, because they set up with Allah that for which He has sent down no authority, and their abode is the fire, and evil is the abode of the unjust.8:60 and prepare against them what force you can and horses tied at the frontier, to terrorize thereby the enemy of Allah...8:12 I will cast terror into the hearts of those who disbelieve. Therefore strike off their heads and strike off every fingertip of them.

Article 4. No one shall be held in slavery or servitude; slavery and the slave trade shall be prohibited in all their forms.

"If a woman offered one of her breasts to be cooked and the other to be roasted, she still will fall short of fulfilling her obligations to her husband. And besides that if she disobeys her husband even for a twinkling of an eye, she would be thrown in the lowest part of Hell, except she repents and turns back." Article 5. No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

Surah 4:34 "Righteous women are therefore obedient, ... And those you fear may be rebellious (nushuz) admonish; banish them to their couches, and beat them."

"No wife shall refuse her husband what he wants from her except on religious grounds ie. at the time of menstrual flow or fasting. Some theologians regard this refusal as unlawful as the husband may get enjoyment from his wife in other ways, by embracing, kissing etc. The duty of the wife is to give him comforts in his bed whenever he wants her." Mishkat al-Masabih, English translation, Book 1, section 'duties of husband and wife', Hadith No.140.

Article 7. All are equal before the law and are entitled without any discrimination to equal protection of the law. All are entitled to equal protection against any discrimination in violation of this Declaration and against any incitement to such discrimination.


Surah 4:11 Allah charges you, concerning your children: to the male the like of the portion of two females, and if they be women above two, then for them two-thirds of what he leaves, but if she be one then to her a half;

Article 16. (1) Men and women of full age, without any limitation due to race, nationality or religion, have the right to marry and to found a family. They are entitled to equal rights as to marriage, during marriage and at its dissolution. (2) Marriage shall be entered into only with the free and full consent of the intending spouses. (3) The family is the natural and fundamental group unit of society and is entitled to protection by society and the State.


Surah 2:230 "if a husband divorces his wife (irrevocably), He cannot, after that, remarry her until after she has married another husband and He has divorced her. In that case there is no blame on either of them if they reunite, provided they feel that they can keep the limits ordained by God. Such are the limits ordained by God, which He makes plain to those who understand”

Article 17. (1) Everyone has the right to own property alone as well as in association with others.

3.118 YUSUFALI: O ye who believe! Take not into your intimacy those outside your ranks: They will not fail to corrupt you. They only desire your ruin: Rank hatred has already appeared from their mouths: What their hearts conceal is far worse. We have made plain to you the Signs, if ye have wisdom.

9.023 YUSUFALI: O ye who believe! take not for protectors your fathers and your brothers if they love infidelity above Faith: if any of you do so, they do wrong.

Article 18.Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, and freedom, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance.

Surah 9:6 But when the forbidden months are past, then fight and slay the pagans wherever ye find them, and seize them, beleaguer them, and lie in wait for them in every stratagem (of war). But if they repent, and establish regular prayers and practice regular charity, then open the way for them.

Surah 9:29 Fight those who believe not in God nor the last day, nor hold that forbidden which hath been forbidden by God and His Apostle, nor acknowledge the religion of truth, (even if they are) of the people of the Book [Bible], until they pay the jizya with willing submission, feel themselves subdued.

9:73 O Prophet! Strive against the disbelievers and the hypocrites! Be harsh with them...

9:123O ye who believe! Fight those of the disbelievers who are near to you, and let them find harshness in you....

Surah an-Nisa' 4:150-151 Lo! those who disbelieve in Allah and His messengers, and seek to make distinction between Allah and His messengers, and say: We believe in some and disbelieve in others, and seek to choose a way in between; Such are disbelievers in truth; and for disbelievers We prepare a shameful doom.

3:85, if anyone desires a religion other than Islam (submission to Allah), never will it be accepted of him; and in the Hereafter He will be in the ranks of those who have lost (All spiritual good).

8:39, and fight them on until there is no more tumult or oppression, and there prevail justice and faith in Allah altogether and everywhere.

10.004 YUSUFALI: To Him will be your return- of all of you. The promise of Allah is true and sure. It is He Who beginneth the process of creation, and repeateth it, that He may reward with justice those who believe and work righteousness; but those who reject Him will have draughts of boiling fluids, and a penalty grievous, because they did reject Him.

Article 20. (1) Everyone has the right to freedom of peaceful assembly and association. (2) No one may be compelled to belong to an association.

Hadith Malik 511:1588 The last statement that Muhammad made was: "O Lord, perish the Jews and Christians. They made churches of the graves of their prophets. There shall be no two faiths in Arabia."

Article 21. (1) Everyone has the right to take part in the government of his country, directly or through freely chosen representatives.

'Allah will not give access to the infidels (i.e. Christians) to have authority over believers (Muslims) {Qur'an 4:141}. For God - Glory be to Him - has elevated Muslims to the highest rank (over all men) and foreordained to them the might, by virtue of the Qurtanic text in which God the Almighty said: 'Might and strength be to Allah, the Prophet (Muhammad) and the believers (Muslims) {Qur'an 63:8}.

Article 25. (1) Everyone has the right to a standard of living adequate for the health and well-being of himself and of his family, including food, clothing, housing and medical care and necessary social services, and the right to security in the event of unemployment, sickness, disability, widowhood, old age or other lack of livelihood in circumstances beyond his control.

"Alms are for the poor and the needy, and those employed to administer the (funds); for those whose hearts have been (recently) reconciled (to Truth); for those in bondage and in debt; in the cause of God; and for the wayfarer: (thus is it) ordained by God, and God is full of knowledge and wisdom" [Surat at-Taubah 9:60; translation by Yusuf Ali]

(2) Motherhood and childhood are entitled to special care and assistance. All children, whether born in or out of wedlock, shall enjoy the same social protection.

"The husband has the right to prevent his wife from looking after and breast feeding her baby, from her previous husband, (if she was living in the husband's house), because that will make her too busy to attend to the husband, and it will affect her beauty and cleanliness, all these are the rights of the husband alone." 'Abd ar-Rahman al-Gaziri, al-Fiqh 'ala al-Mazahib al-Arba'a, Dar al-Kutub al- 'Elmeyah, 1990, vol. 4, p. 488.

"Narrated 'Urwa : The Prophet asked Abu Bakr for 'Aisha's hand in marriage. Abu Bakr said, 'but I am your brother.' The Prophet said, 'You are my brother in Allah's religion and His Book, But she ('Aisha) is lawful for me to marry.'"[164] (Mohammad was fifty years old, and 'Aisha was six or seven years old at that time, but the marriage was consummated when she turned nine years old). Article 28. Everyone is entitled to a social and international order in which the rights and freedoms set forth in this Declaration can be fully realized.

Article 29. (1) Everyone has duties to the community in which alone the free and full development of his personality is possible.

(2) In the exercise of his rights and freedoms, everyone shall be subject only to such limitations as are determined by law solely for the purpose of securing due recognition and respect for the rights and freedoms of others and of meeting the just requirements of morality, public order and the general welfare in a democratic society.

(3) These rights and freedoms may in no case be exercised contrary to the purposes and principles of the United Nations

Article 30. Nothing in this Declaration may be interpreted as implying for any State, group or person any right to engage in any activity or to perform any act aimed at the destruction of any of the rights and freedoms set forth herein

The fact that the Muslim keep saying that they want 'human right' is a pure contraction to the Koran. Either they ignorant or they are playing al-Taqyyha -lying as mandated by the Koran "3:28 Let not the believers Take for friends or helpers Unbelievers rather than believers: if any do that, in nothing will there be help from God: except by way of precaution, that ye may Guard yourselves from them. But God cautions you (To remember) Himself; for the final goal is to God.'

Either way, shame on any Westener that fall into that trap. We need to read the Koran and ask ourselves if we are ready to surrender our dignities to the law of a desert , to psychopaths. Amen.

Islamic law in the West? ...No more human rights!

Shariah Law primer, basic points

1. No Separation of Church and State. Goverment, law and religion are one.

2. The religion of Islam and the government are one.

3. Islamic Law is controlled, ruled and regulated by the Islamic religion.

4. The theocracy controls all public and private matters.

5. There are civil laws in Muslim nations for Muslim and non-Muslim people. Shar’iah is only applicable to Muslims.


Elements of Shar’iah Law
. Islamic law is known as Shariah Law, and Shariah means the path to follow God’s Law.
. Shariah Law controls, rules and regulates all public and private behaviour.
. It has regulations for personal hygiene, diet, sexual conduct, and elements of child rearing. It also prescribes specific rules for prayers, fasting, giving to the poor, and many other religious matters. Civil Law and Common Law primarily focus on public behaviour, but both do regulate some private matters.


. The first and primary element of Shar’iah Law is the Qur’an. It is the final arbitrator and there is no other appeal.

. The second element of Shar’iah Law is known as the Sunna, the teachings of the Prophet Mohammad not explicitly found in the Qur’an. The Sunna are a composite of the teachings of the Prophet and his works. The Sunna contain stories and anecdotes, called Hadith, to illustrate a concept. The Qur’an may not have all the information about behaviour and human interaction in detail; the Sunna gives more detailed information than the Qur’an.

. The third element of Shar’iah Law is known as the Ijma. The Muslim religion uses the term Ulama as a label for its religious scholars. These Ulama’s are consulted on many matters both personal and political. When the Ulama’s reach a consensus on an issue, it is interpreted as Ijma. The concepts and ideas found in the Ijma are not found explicitly in the Qur’an or the teachings of the Prophet (Sunna). Islamic judges are able to examine the Ijma for many possible solutions which can be applied in a modern technical society.


Crimes in Islam
Crimes under Islamic Law can be broken down into three major categories. The three major crime categories in Islamic Law are: 1. Hadd [plural Hudud] Crimes (most serious).2. Tazir Crimes (least serious).3. Qesas Crimes (revenge crimes restitution).

Hadd crimes are the most serious under Islamic Law, and Tazir crimes are the least serious

Punishments are prescribed in the Qur’an and are often harsh with the emphasis on corporal and capital punishment. Theft is punished by imprisonment or amputation of hands or feet, depending on the number of times it is committed . . .Hadd crimes are those which are punishable by a pre-established punishment found in the Qur’an. These most serious of all crimes are found by an exact reference in the Qur’an to a specific act and a specific punishment for that act. There is no plea-bargaining or reducing the punishment for a Hadd crime. Hadd crimes have no minimum or maximum punishments attached to them. No judge can change or reduce the punishment for these serious crimes.

The Hadd crimes are:

1.Murder

2. Apostasy from Islam

3. (making war upon Allah and His messengers)

4. Theft

5. Adultery

6. Defamation (false accusation of adultery or fornication)

7. Robbery

8. Alcohol-drinking [any intoxicants]

The first four Hadd crimes have a specific punishment in the Qur’an. The last three crimes are mentioned but no specific punishment is found .

Hadd crimes are crimes against God’s law and Tazir crimes are crimes against society.

Tazir Crimes
Tazir crimes are less serious than the Hadd crimes found in the Qur’an. Some common law writers use the analogy of misdemeanors, which is the lesser of the two categories (felony and misdemeanor) of common law crimes. Tazir crimes can and do have comparable “minor felony equivalents.” These “minor felonies” are not found in the Qur’an so the Islamic judges are free to punish the offender in almost any fashion. Mohammed Salam Madkoar, who was the head of Islamic Law at the University of Cairo, makes the following observation (Ministry of the Interior, 1976, p.104):


. Tazir punishments vary according to the circumstances

. Tazir crimes are acts which are punished because the offender disobeys God’s law and word. Tazir crimes can be punished if they harm the societal interest.

. The judge under Islamic Law is not bound by precedents, rules, or prior decisions as in common law. Judges are totally free to choose from any number of punishments that they think will help an individual offender. The only guiding principle for judges under Shar’iah Law is that they must answer to Allah and to the greater community of Muslims. Some of the more common punishments for Tazir crimes are counseling, fines, public or private censure, family and clan pressure and support, seizure of property, confinement in the home or place of detention, and flogging.

Some of the more common Tazir crimes are: Bribery, selling tainted or defective products, treason usury
selling obscene pictures.

Qesas Crimes and DiyaIslamic Law has an additional category of crimes that common law nations do not have. A Qesas crime is one of retaliation. If you commit a Qesas crime, the victim has a right to seek retribution and retaliation. The exact punishment for each Qesas crime is set forth in the Qur’an.

If you are killed, then your family has a right to seek Qesas punishment from the murderer. Punishment can come in several forms and also may include “Diya.” Diya is paid to the victim’s family as part of punishment. Diya is an ancient form of restitution for the victim or his family. The family also may seek to have a public execution of the offender or the family may seek to pardon the offender.

Traditional Qesas crimes include:
1. Murder (premeditated and non-premeditated).

2. Premeditated offences against human life, short of murder.

3. Murder by error.

4. Offences by error against humanity, short of murder.

2.228 YUSUFALI: Divorced women shall wait concerning themselves for three monthly periods. Nor is it lawful for them to hide what Allah Hath created in their wombs, if they have faith in Allah and the Last Day. And their husbands have the better right to take them back in that period, if they wish for reconciliation. And women shall have rights similar to the rights against them, according to what is equitable; but men have a degree (of advantage) over them. And Allah is Exalted in Power, Wise. Men are protectors and maintainers of women; women must be devoutly obedient, if not then beat them...

4.034 YUSUFALI: Men are the protectors and maintainers of women, because Allah has given the one more (strength) than the other, and because they support them from their means. Therefore the righteous women are devoutly obedient, and guard in (the husband's) absence what Allah would have them guard. As to those women on whose part ye fear disloyalty and ill conduct, admonish them (first), (Next), refuse to share their beds, (And last) beat them (lightly); but if they return to obedience, seek not against them Means (of annoyance): For Allah is Most High, great (above you all).

30.021 YUSUFALI: And among His Signs is this, that He created for you mates from among yourselves, that ye may dwell in tranquillity with them, and He has put love and mercy between your (hearts): verily in that are Signs for those who reflect.

12.109YUSUFALI: Nor did We send before thee (as messengers) any but men, whom we did inspire,- (men) living in human habitations. Do they not travel through the earth, and see what was the end of those before them? But the home of the hereafter is best, for those who do right. Will ye not then understand?

16.043YUSUFALI: And before thee also the messengers We sent were but men, to whom We granted inspiration: if ye realise this not, ask of those who possess the Message.

Book 031, Number 5966: Abu Musa reported Allah's Messenger (may peace be upon him) as saying: There are many persons amongst men who are quite perfect but there are not perfect amongst women except Mary, daughter of 'Imran, Asiya wife of Pharaoh, and the excellence of 'A'isha as compared to women is that of Tharid over all other foods.

(Sunaan Abu Dawud 11.2135) “If I were to command anyone to make prostration before another I would command women to prostrate themselves before their husbands, because of the special right over them given to husbands by Allah.

2.282 YUSUFALI: O ye who believe! When ye deal with each other, in transactions involving future obligations in a fixed period of time, reduce them to writing Let a scribe write down faithfully as between the parties: let not the scribe refuse to write: as Allah Has taught him, so let him write. Let him who incurs the liability dictate, but let him fear His Lord Allah, and not diminish aught of what he owes. If they party liable is mentally deficient, or weak, or unable Himself to dictate, Let his guardian dictate faithfully, and get two witnesses, out of your own men, and if there are not two men, then a man and two women, such as ye choose, for witnesses, so that if one of them errs, the other can remind her.

Shahih Bukhari 1.6.301 Once Allah's Apostle went out to the Musalla (to offer the prayer) o 'Id-al-Adha or Al-Fitr prayer. Then he passed by the women and said, "O women! Give alms, as I have seen that the majority of the dwellers of Hell-fire were you (women)." They asked, "Why is it so, O Allah's Apostle ?" He replied, "You curse frequently and are ungrateful to your husbands. I have not seen anyone more deficient in intelligence and religion than you. A cautious sensible man could be led astray by some of you."

Book 11, Number 2155 :“The Prophet (peace_be_upon_him) said: If one of you marries a woman or buys a slave, he should say: "O Allah, I ask Thee for the good in her, and in the disposition Thou hast given her; I take refuge in Thee from the evil in her, and in the disposition Thou hast given her." When he buys a camel, he should take hold of the top of its hump and say the same kind of thing.”

Shahih Bukhari 1.9.490 “The things which annul the prayers were mentioned before me. They said, "Prayer is annulled by a dog, a donkey and a woman (if they pass in front of the praying people)."

2.222 PICKTHAL: They question thee (O Muhammad) concerning menstruation. Say: It is an illness, so let women alone at such times and go not in unto them till they are cleansed. And when they have purified themselves, then go in unto them as Allah hath enjoined upon you. Truly Allah loveth those who turn unto Him, and loveth those who have a care for cleanness.

The Sha’ria m5.4 (Ref: 8, p526) husbands rights A husband possesses full right to enjoy his wife’s person (A: from the top of her head to the bottoms of her feet, though anal intercourse (dis: p75.20) is absolutely unlawful) in what does not physically harm her.

Book 008, Number 3367: Abu Huraira (Allah be pleased with him) reported Allah's Messenger (may peace be upon him) as saying: By Him in Whose Hand is my life, when a man calls his wife to his bed, and she does not respond, the One Who is in the heaven is displeased with her until he (her husband) is pleased with her.

Sharia, duties of a wife m5.1 (Ref: 8, p525) It is obligatory for a woman to let her husband have sex with her immediately when (a) he asks her; (b) at home (O: home meaning the place in which he is currently staying, even if being lent to him or rented); (c) and she can physically endure it. (d) (O: Another condition that should be added is that her marriage payment (mahr, def: m8) has been received or deferred to a term not yet expired.

The husband is entitled to insist that his wife undertake both the measures necessary for having sex with her such as the purificatory bath (ghusl) after her monthly period, and those necessary to full enjoyment of her such as the purificatory bath after major ritual impurity (janaba), shaving her private parts, and removing filth.

m10.4 (Ibid, p538) wife can’t leave home. The husband may forbid his wife to leave the home (O: because the hadith related by Bayhaqi that the Prophet (Allah bless him and give him peace) said, “It is not permissible for a woman who believes in Allah and the Last Day to allow someone into her husband’s house if he is opposed, or to go out if he is averse”). But if one of her relatives dies, it is preferable to let her leave to visit them.

w45.1 (Ibid, p948) wife’s obligation (Abu Ishaq Shirazi:) A woman is not obliged to serve her husband by baking, grinding flour, cooking, washing, or any other kind of service, because the marriage contract entails, for her part, only that she let him enjoy her sexually, and she is not obligated to do other than that.

e4.3 Female circumcision (Ref: 8, p59)Circumcision is obligatory (O: for both men and women. For men it consists of removing the prepuce from the penis, and for women, removing the prepuce (Ar.Bazr) of the clitoris (n: not the clitoris itself, as some mistakenly assert). (A: Hanbalis hold that the circumcision of women is not obligatory but sunna, while Hanafis consider it a mere courtesy to the husband.)

Islam a religion of peace? What about these?

1. "O prophet Muhammad urge the believers (Muslims) to fight" (Surat Al-Anfal 8:65)."Jihad (holy fighting in Allah's cause) is ordained for you" (Surat Al-Baqarah 2:216).


2. "O ye who believe (Muslims) take not the Jews or the Christians for your friends and protectors. They are but friends and protectors to each other. And he among you that turns to them (for friendship) is of them" (Surat Al-Maidah 5:51).


3. ‘Fight against those who believe not in Allah, nor in the Last Day, nor forbid that which has been forbidden by Allah and His Messenger (Muhammad) and those who acknowledge not the religion of truth (Islam) among the people of the Scripture (Jews and Christians) until they pay the Jizyah with willing submission, and feel themselves subdued" (Surah At-Taubah 9:29).


4. "And fight them until there is no more Fitnah (disbelief and worshipping of others along with Allah) and (all and every kind of) worship is for Allah (alone). But if they cease, let there be no transgression except against As-Zatimun (the polytheists and wrong doers)" (Surat Al-Baqarah 2:193).


5. "And if you are killed or die in the Way of Allah, forgiveness and mercy from Allah are far better than all that they amass (of worldly wealth)" (Surat Al-Imran 3:157).

6. "Verily, Allah has purchased of the believers their lives and their properties for (the price) that theirs shall be the Paradise. They fight in Allah's Cause, so they kill (others) and are killed. It is a promise in truth which is binding on Him" (Surat At-Taubah 9:111).


7. "Verily I am with you, so keep firm those who have believed. I will cast terror into the hearts of those who have disbelieved, so strike them over the necks and smite over all their fingers and toes. This is because they defied and disobeyed Allah and His Messenger (Muhammad). And whoever defies and disobeys Allah and His Messenger, them verily, Allah is Severe in punishment. This is (the torment), so taste it; and surely, for the disbelievers is the torment of the Fire" (Surat Al-Anfal 8:12-14).


8. "The recompense of those who wage war against Allah and His Messenger (Muhammad) and do mischief in the land is only that they shall be killed or crucified or their hands and feet be cut off from opposite sides, or be exiled from the land. That is their disgrace in this world, and a great torment is theirs in the Hereafter" (Surat Al-Maidah 5:33).


9. "Verily, Allah loves those who fight in His Cause in rows as if they were solid structures" (Surat As-Saff 61:4)."Kill the Mushrikun (polytheists, Christians and non-Muslims), wherever you find them, and capture them and besiege them, and lie in wait for them in each and every ambush. But, if they repent and perform As-salat (public prayer with Muslims) and give Zakat (Islamic alms), then leave their way free. Allah is oft-forgiving, most merciful" (Surat At-Taubah 9:5).
